Please read this privacy policy ('Policy') carefully before using the Application, Website, our services and products, along with the Terms of Use ('ToU') provided on the Application and the Website. Your use of the Website, Application, or services in connection with the Application, Website or products ('Services'), or registrations with us through any modes or usage of any products including through SD cards, tablets or other storage/transmitting device shall signify your acceptance of this Policy and your agreement to be legally bound by the same. If you do not agree with the terms of this Policy, do not use the Website, Application our products or avail any of our Services.

User Provided Information

The Application/Website/Services/products obtains the information you provide when you download and register for the Application or Services or products. When you register with us, you generally provide (a) your name, age, email address, location, phone number, password and your ward's educational interests; (b) transaction-related information, such as when you make purchases, respond to any offers, or download or use applications from us; (c) information you provide us when you contact us for help; (d) information you enter into our system when using the Application/Services/products, such as while asking doubts, participating in discussions and taking tests. The said information collected from the users could be categorized as “Personal Information”, “Sensitive Personal Information” and “Associated Information”. Personal Information, Sensitive Personal Information and Associated Information (each as individually defined under this Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 (the “Data Protection Rules”)) shall collectively be referred to as 'Information' in this Policy. We may use the Information to contact you from time to time, to provide you with the Services, important information, required notices and marketing promotions. We will ask you when we need more information that personally identifies you (personal information) or allows us to contact you. We will not differentiate between who is using the device to access the Application, Website or Services or products, so long as the log in/access credentials match with yours. In order to make the best use of the Application/Website/Services/products and enable your Information to be captured accurately on the Application/Website/Services/products, it is essential that you have logged in using your own credentials. We will, at all times, provide the option to you to not provide the Personal Information or Sensitive Personal Information, which we seek from you. Automatically Collected Information

In addition, the Application/products/Services may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application/Services/products. As is true of most Mobile applications, we also collect other relevant information as per the permissions that you provide. We use an outside credit card processing company to bill you for goods and services. These companies do not retain, share, store or use personally identifiable information for any other purpose.

At the time you (on behalf of yourself and/or your ward) register with us for our Services or during the term of Services relating to our products/services/subscriptions, we may require camera and microphone access while you avail such products/services/subscriptions to improve the in-classroom experience. All video, audio and telecalls between you/your ward and our tutors/representatives/agents are recorded for quality and training purposes. These recordings shall not be shared with you/your ward for any reasons whatsoever. By agreeing to this Privacy Policy, you (on behalf of yourself and/or your ward) consent to our collection/ recording and use of your and/or your ward’s audio/video/telecall recordings and personal information for the above-mentioned purposes.

Use of your Personal Information

We use the collected Information to analyse trends, to conduct research, to administer the Application/Services and products, to learn about each user's learning patterns and movements around the Application/Services and products and to gather demographic information and usage behaviour about our user base as a whole. Aggregated and individual, anonymized and non-anonymized data may periodically be transmitted to external service providers to help us improve the Application, products and our Services. We will share your information with third parties only in the ways that are described below in this Policy. We may use the individual data and behavior patterns combined with personal information to provide you with personalized content, and better your learning objectives. Third parties provide certain services which we may use to analyze the data and information to personalize, drive insights and help us better your experience or reach out to you with more value added applications, products, information and services. However, these third party companies do not have any independent right to share this information. We do not sell, trade or share your Information to any third party (except subsidiaries/affiliates of theCompany for related offerings) unless, we have been expressly authorized by you either in writing or electronically to do so.   • Any portion of the Information containing personal data relating to minors provided by you shall be deemed to be given with the consent of the minor's legal guardian. Such consent is deemed to be provided by your registration with us.

We will provide you with the means to ensure that your Personal Information is correct and current. If you have filled out a user profile, we will provide an obvious way for you to access and change your profile from our Application/Services/Website/products. TheseTerms & Conditions (“Terms”) of (a) use of our website https://paicieltslearningschool.com (“Website”), our applications (“Application”) or any products or services in connection with the Application/,  Website/products (“Services”)  or (b) any modes of registrations or usage of products, including through SD cards, tablets or other storage/transmitting device  are between Think & Learn Private Limited (“Company/We/Us/Our”) and its users (“User/You/Your”).

These Terms constitute an electronic record in accordance with the provisions of the Information Technology Act, 2000 and the Information Technology (Intermediaries guidelines) Rules, 2011 thereunder, as amended from time to time.

Please read the Terms and the privacy policy of the Company (“Privacy Policy”) with respect to registration with us, the use of the Application, Website, Services and products carefully before using the Application, Website, Services or products. In the event of any discrepancy between the Terms and any other policies with respect to the Application or Website or Services or products, the provisions of the Terms shall prevail.

Your use/access/browsing of the Application or Website or the Services or products or registration (with or without payment/with or without subscription) through any means shall signify Your acceptance of the Terms and Your agreement to be legally bound by the same.

The Company acknowledges that there are various means of delivering structured curriculum pedagogy and inclusion of methods in the Application/Services/products does not imply endorsement of any particular method nor exclusion imply disapproval. Subscription to the Application or usage of our Services/Website/products does not in any manner guarantee admission to any educational institutions or passing of any exams or achievement of any specified percentage of marks in any examinations.

The User expressly grants such permission to contact him/her through telephone, SMS, e-mail and holds the Company (including but not limited to its subsidiaries/affiliates) indemnified against any liabilities including financial penalties, damages, expenses in case the User's mobile number is registered with Do not Call (DNC) database. By registering yourself, you agree to make your contact details available to Our employees, associates, subsidiaries,affiliates and partners so that you may be contacted for education information, offerings and promotions through telephone, SMS, email etc.

While the Company may, based on the User's confirmation, facilitate the demonstration of its products at the location sought by the User, the User acknowledges that he/she has not been induced by any statements or representations of any person with respect to the quality or conditions of the products and that User has relied solely on the investigations, examinations and inspections as the User has chosen to make and that the Company has afforded the User the opportunity for full and complete investigations, examinations and inspections.
  1. Upon registration through any means whatsoever, the Company may contact You through the registered mobile number or e-mail or any other mobile number or contact number or email provided by You to enable effective provision of Services. The User expressly permits the Company to contact him/her and the student utilising the Services, through the above mentioned means at any time post registration. .-. Further, the Company shall have the right to monitor the download and usage of the Application/Services/products and the contents thereof by the User/student, to analyze such usage and discuss the same with the User/student to enable effective and efficient usage of the Services. The User expressly permits the Company to clear the doubts of the student using the Application/Services/online portal by answering the questions placed before it, providing study plans, informing of the progress, providing feedback, communicating with the student and mentoring the student through telephone or e-mail on express consent of the legal guardian/parent of the User or through any other forum.
  1. While the Company has made efforts to train the personnel engaged in the sales and services relating to its products to enable quality control, it makes no warranties or representations whatsoever regarding the quality and competence of such personnel and would not be responsible for any deviant behaviour of any such personnel. Any feedback from User relating to the same is most welcome and Company reserves the right and discretion to take any action in this regard.
  1. Access to certain elements of the Services including doubt clearance, mentoring services etc may be subject to separate terms, conditions and fair usage policy. The Company reserves the right to determine the criteria for provision of various elements of Services to the different categories of Users based on its policies. Hence, subscription to the Application/products or registrations do not automatically entitle the User to any and all elements of Services provided by the Company and the Company shall be entitled to exercise its discretion while providing access to and determining continuity of certain elements of Services. We reserve the right to extend, cancel, discontinue, prematurely withdraw or modify any of Our Services at Our discretion.
  1. The Company's products and / or Services, including the Application and content, are compatible only with certain devices/tablets/instruments/hardware < . The Company shall not be obligated to provide workable products and / or services for any instruments that are not recognized by the Company or those instruments that may be purchased from any third party which are not compatible with the Company's products and ServicesThe company reserves the right to upgrade the table/ type of compatible devices as required from time to time.
  1. The Company shall have no responsibility for any loss or damage caused to tablet or any other hardware and / or software and/or instrument, including loss of data or effect on the processing speed, resulting from Your use of our products and Services.
  1. In order to encourage Customer Retention and Loyalty, PAIC IELTS Learning encourages its Customers, Fintech Partners and other stakeholders to refer customers to buy PAIC IELTS Learning Products & Services. Company at its option can pay referral bonus subject to applicable laws. Since this is an optional selective policy of the Company, the decision of the Company is final and the same cannot be either disputed or challenged. It should be noted with abundant caution that no Customer, Fintech Partner or other stake holder shall do business with the Company in anticipation of such Bonus. Company shall not be held responsible if some Customer has done business with the objective of getting referral bonus as Bonus paid by the Company is purely dependent on its own discretion based on internal parameters and various demographic and economic factors.
  1. You have to specify the address to which the shipment has to be made at the time of purchase. All product(s) shall be delivered directly to the address as specified at the point of ordering and You cannot, under any circumstances whatsoever, change the address after the order is processed. In case of any change in the address, You need to specify the same to us in writing well in advance to the shipping date. Any inconsistencies in name or address will result in non-delivery of the product(s).
  1. (a) For return of product(s) damaged at the time of delivery, the shipping charges shall be borne by the Company. However, for return any of the product(s) for any other reasons, it shall be the responsibility of the User to arrange for the return of such cancelled product(s) and the shipping charges shall be borne by such User. (b)We request You not to accept any product package that seems to be tampered with, opened or damaged at the time of delivery. The products must be returned in the same condition as delivered by the Company. Any products returned showing signs of any use or damage in any manner shall not be accepted for return. (c)All requests for return of products have to be placed within 15 (fifteen) days from the date of delivery. Please note that no refunds shall be claimed or will be entertained post 15 (fifteen) days from the date of delivery.
  1. You acknowledge that the Company is not the manufacturer of the instrument/medium/hardware and hence, any defect relating to the same shall be reported to the manufacturer whose details shall be specifed on the packaging and the Company shall not be in any manner responsible for the same. The Company does not provide any guarantee or warranty relating to the instrument/medium/hardware
  1. In order to access the Services and to avail the use of the Application/products, You shall be required to register yourself with the Application/Services/products, and maintain an account with the Application/Services/products. You will be required to furnish certain information and details, including Your name, mobile number, e-mail address, residential address, grade/class of the student, school name, payment information (credit/debit card details) if required, and any other information deemed necessary by the Application. With respect to the provision of information, the following may be noted:-
  • It is Your sole responsibility to ensure that the account information provided by You is accurate, complete and latest.
  • You shall be responsible for maintaining the confidentiality of the account information and for all activities that occur under Your account. You agree to (a) ensure that You successfully log out from Your account at the end of each session; and (b) immediately notify the Company of any unauthorized use of Your account. If there is reason to believe that there is likely to be a breach of security or misuse of Your account, we may request You to change the password or we may suspend Your account without any liability to the Company, for such period of time as we deem appropriate in the circumstances. We shall not be liable for any loss or damage arising from Your failure to comply with this provision.
  • You acknowledge that Your ability to use Your account is dependent upon external factors such as internet service providers and internet network availability and the Company cannot guarantee accessibility to the Application at all times. Tailored advertising controls

What is tailored advertising?

 

This is when we use information about you to tailor ads to be more relevant to you. This is also known as interest based advertising.

An example of tailored advertising is when an advertising partner has information suggesting you like cars. This could enable us to show you ads about cars.

How to control tailored advertising:

 

You can control tailored advertising in your account Privacy Settings under 'Tailored Ads'.

You can also control tailored advertising for some podcasts using the link in the episode's show description. This applies where the content provider inserts advertising into the podcast to fund it. The hosting provider, which might not be Spotify, manages these controls for the podcast.

If you are 'opted out' of Tailored Ads in your Privacy Settings, you may still get advertising. This can include on our free Service Option, as well as our paid Service Option, as applicable (for example, advertising in podcasts). This type of advertising is based on your registration information and what you are currently listening to on our services. 5. Sharing your personal data

This section sets out who receives personal data which is collected or generated through your use of the Spotify Service.

 

Publicly available information

 

The following personal data will always be publicly available on the Spotify Service (except to any user you have blocked):

 

your profile name

your profile photo

your public playlists

other content you post on the Spotify Service, and any associated titles, descriptions and images

who you follow on the Spotify Service

who follows you on the Spotify Service

You or another user can share certain information on third party services, like social media or messaging platforms. This includes:

 

your profile

any content you post on Spotify and details about that content

your public playlists

When this sharing occurs, the third party service may store a copy of it to support their features.

 

Personal data you may choose to share

 

We will only share the following personal data with those outlined in the table below:

 

where you have chosen to use a Spotify Service feature, or a third party application, service or device, and we need to share personal data to enable this, or

if you otherwise grant us your permission to share the personal data. For example, you can do it by selecting the appropriate setting in the Spotify Service or by giving your consent

When you register for an account on the Spotify Support Community, we’ll ask you to create a profile name. This will be publicly displayed to anyone who uses the Spotify Support Community. We’ll also display any questions or comments you post.

For example, under ‘Social’ settings you can choose to share your recently played artists and your playlists on your profile. You can also choose to create or join a shared playlist with other users. Shared playlists give you social recommendations based on your listening activity.

Hosting Platforms

Hosting platforms host podcasts so that they can deliver them to you. We share certain data, such as your IP address, with the hosting platforms when you play a podcast. We also allow you to stream podcasts available from other hosting platforms not owned by Spotify.

 

Podcast providers should explain in the show or episode description which platform is hosting the podcast. See the hosting platform’s own privacy policy for how they use data shared with them.

6. Data retention

We keep your personal data only as long as necessary to provide you with the Spotify Service and for Spotify's legitimate and essential business purposes, such as:

 

maintaining the performance of the Spotify Service

making data-driven business decisions about new features and offerings

complying with our legal obligations

resolving disputes

Here are some of the categories of our retention periods:

 

Data retained until you remove it

It's your right to request that we delete certain of your personal data. See the section on 'Erasure' in Section 2 'Your personal data rights and controls' for more information.

 

Data that expires after a specific period of time

We have set certain retention periods so that some data expires after a specific period of time.

 

Data retained until your Spotify account is deleted

We keep some data until your Spotify account is deleted. When your Spotify account is deleted, your data is deleted or anonymised.

 

Data retained for extended time periods for limited purposes

After your account is deleted, we keep some data for a longer time period but for very limited purposes.

 

Criteria used to determine the retention periods include:

 

What is the appropriate retention period to carry out our purpose? Our systems are designed to automatically 'age out' data based on a defined retention period. We choose the retention period based on its legitimate business purpose.

Do we need to keep data to ensure the service that users expect? We keep personal data for an appropriate period to deliver a personalised service to our users over time. We typically keep streaming history for the life of an account, for example, to provide retrospective playlists that users enjoy and personalised recommendations that take listening habits into account. For example, Your Summer Rewind and the end-of-year Wrapped campaign.

Are users able to update or delete the data themselves? Where users are able to see and update the personal data themselves, we keep the information for as long as the user chooses.

Do we need to keep the data to uphold our rules and keep our service safe? We may keep data that has been removed from the Spotify Service for a limited period of time. This is:

to help ensure user safety

to protect against harmful content on our platform

to take action with reports of intellectual property infringement

This also helps us investigate potential breaches of our User Guidelines and Platform Rules.

 

Is Spotify subject to a legal or contractual obligation to keep or delete the data? Examples include mandatory data retention laws, government orders to preserve data relevant to an investigation or data kept for the purposes of litigation. Conversely, we will remove unlawful content if the law requires us to do so.

7. Transfer to other countries

Because of the global nature of our business, your personal data will be shared internationally among Spotify group companies, subcontractors and partners when carrying out the activities described in this Policy. They may process your data in countries whose data protection laws are not considered to be as strong as EU laws or the laws which apply where you live. For example, they may not give you the same rights over your data.

 

Whenever we transfer personal data internationally, we use tools to:

 

make sure the data transfer complies with applicable law

help to give your data the same level of protection as it has in the EU

To ensure each data transfer complies with applicable EU legislation, we use the following legal mechanisms:

 

Standard Contractual Clauses ('SCCs'). These clauses require the other party to protect your data and to provide you with EU-level rights and protections. For example, we use SCCs to transfer the personal data described in Section 3 'Personal data we collect about you' to our hosting provider which uses servers in the US. You can exercise your rights under the Standard Contractual Clauses by contacting us or the third party who processes your personal data.

Adequacy Decisions. This means that we transfer personal data to countries outside of the European Economic Area which have adequate laws to protect personal data, as determined by the European Commission. For example, we transfer the personal data described in Section 3 'Personal data we collect about you' to vendors based in the United Kingdom, Canada, Japan, Republic of Korea and Switzerland.

We also identify and use additional protections as appropriate for each data transfer. For example, we use:

 

technical protections, such as encryption and pseudonymisation

policies and processes to challenge disproportionate or unlawful government authority requests

8. Keeping your personal data safe

We're committed to protecting our users' personal data. We put in place appropriate technical and organisational measures to help protect the security of your personal data. However, be aware that no system is ever completely secure.

 

We have put various safeguards in place including pseudonymisation, encryption such as Transport Layer Security (TLS) and AES, access, and retention policies to guard against unauthorised access and unnecessary retention of personal data in our systems. In addition, personal data stored in our computer systems are secured by physical security measures.

 

To protect your user account, we encourage you to:

 

use a strong password which you only use for your Spotify account

never share your password with anyone

limit access to your computer and browser

log out once you have finished using the Spotify Service on a shared device

You can log out of Spotify in multiple places at once by using the 'Sign out everywhere' function on your account page.

 

If other individuals have access to your Spotify account, then they can access personal data, controls and the Spotify Service available in your account. For example, you might have allowed someone to use your account on a shared device.

 

It's your responsibility to only allow individuals to use your account where you're comfortable sharing this personal data with them. Anyone else's use of your Spotify account may impact your personalised recommendations and be included in your data download.

 

9. Children

Note: This Policy doesn't apply to Spotify Kids unless the Spotify Kids Privacy Policy says so. Spotify Kids is a separate Spotify application.

 

The Spotify Service has a minimum 'Age Limit' in each country or region. The Spotify Service is not directed to children whose age:

 

is under the age of 13 years

makes it illegal to process their personal data, or

requires parental consent to process their personal data

We do not knowingly collect or use personal data from children under the applicable Age Limit. If you're under the Age Limit, do not use the Spotify Service, and do not provide any personal data to us. Instead, we recommend using a Spotify Kids account.

 

If you're a parent of a child under the Age Limit and become aware that your child has provided personal data to Spotify, contact us.

 

If we learn that we've collected the personal data of a child under the applicable Age Limit, we'll take reasonable steps to delete the personal data. This may require us to delete the Spotify account for that child.

 

When using a shared device on the main Spotify Service, be cautious about playing or recommending any inappropriate content to individuals under 18 years old.

 

10. Changes to this Policy

We may occasionally make changes to this Policy.

 

When we make material changes to this Policy, we'll provide you with prominent notice as appropriate under the circumstances. For example, we may display a prominent notice within the Spotify Service or send you an email or device notification.
